More employment law changes on the way?

Paul Dancey on 09/05/2012

There is a proposal in the offing to charge employees for bringing claims to employment tribunals.

The idea is to charge up to £1,750 in certain cases. It is hoped that this would dissuade sacked workers from bringing speculative or vexatious claims that cost companies a fortune to defend.

It costs companies on average over £5,000 in costs to defend claims and normally those costs cannot be reclaimed even if the company wins.

There are also plans to impose fines on companies that lose claims (on top of the actual award to the worker).

This would clearly put even more pressure on companies to settle in advance with claimants rather than go all the way to a tribunal.
